About the Book:
Deposition Law and Strategy is designed so that litigation attorneys can use it in connection with the conduct of depositions. The work is divided into two parts: The First Part is an Introduction to Deposition Strategy, the Second Part, Deposition Law, is a detailed analysis and commentary on the Federal Rules of Civil Procedure dealing with discovery and those sections relevant to depositions.

Part I, Introduction to Deposition Strategy, covers aspects of deposition practice and procedure, including initial planning, preparation, taking, defending and use. An attempt will be made to present some of the various options or alternatives available to practitioners regarding deposition practices and the considerations which should govern the decisions which must be made at various points of the discovery process. This part does not detail the law governing depositions. A review of the relevant legal standards will be presented where deemed appropriate. The commentary in this section apply to general considerations and techniques usable in the examination of a deponent.

Part II, the Deposition Law section, should be consulted for an analysis of the Federal Rules on which the majority of states have relied in modeling their own procedures. The Deposition Law Section is divided into seven subsections: Dep.Law.01 deals with Rule 30 which prescribes the procedure for taking depositions upon oral examination; Dep.Law.02 discusses Rule 31 which provides for the taking of depositions upon written questions; Dep.Law.03 analyzes the provisions of Rule 32 governing the use of deposition testimony at trial; Dep.Law.04 contains a discussion of Rule 27 which permits depositions to be conducted for the purpose of perpetuating evidence; Dep.Law.05 examines Rule 28 which lists those who may preside at depositions; and Dep.Law.06 sets forth the provisions of Rule 29 which permits the broad use of stipulations to alter the application of the other deposition rules; Dep.Law.07 contains a collection of forms which should serve to illustrate how to proceed under the aforementioned rules.

Francis A. C. Sevier received his B.S., M.S., and Ph.D., in Mathematics from the University of Pennsylvania and his J.D. and L.L.M. from Temple University School of Law. A member of the Bar of the District of Columbia, Florida and the Supreme Court of the United States, Recently retired from his Miami firm, Lanza, Sevier & O’Connor he has practiced, for 40 years, predominantly in the area of insurance. He is the author of “Insurance Depostions” (Juris, 1999) Throughout an active trial practice, as counsel in more than 300 jury trials, Mr. Sevier has taught, as an adjunct professor, at the University of Miami School of Law. He has been host of a television series, “Law and Modern Society”, sponsored by the University of the Air; authored 4 books; and published numerous articles in insurance. As a guest lecturer, he has spoken at judicial conferences, medical society meetings, bar conventions, insurance seminars, continuing legal education programs and trial attorney forums. Mr. Sevier has been president of the Dade County Defense Bar Association; has served on the boards of directors of insurance companies, universities and commercial enterprises; has served as president of an insurance company engaged in writing liability coverage for members of the Florida Bar and as general counsel for another insurance company engaged solely in writing medical malpractice insurance.
