Finding:
Under French law, the arbitrator’s dismissal of an application for interim
payment was not considered an award since it did not put an end to “the
litigation”. The decision could then not be challenged before French
courts.

EXTRACT FROM THE JUDGMENT
Un contrat d’agence d’une durée de cinq ans, automatiquement
reconductible, à effet du 1er avril 1983, a été signé entre la société de droit
anglais Diversey Limited (ci-après Diversey Ltd), numéro
d’immatriculation 1585827, dont le siège social est à Northampton, et
Moassassat Al Amaal Wa Attijara Arabia al Doualia ”Arab Business and
Commerce International Est”, établissement du Prince Bandar Bin Khaled
Bin Abdelaziz Al Saud, ABC International, immatriculé au registre du
commerce 30266/Djeddah (ci-après ABC) donnant à l’agent local ABC
mandat exclusif pour la vente en Arabie Saoudite de tous les produits,
services et fournitures des sociétés affiliées au Groupe Diversey et
prévoyant le versement d’une commission de 10 % sur le chiffre total de
ces ventes de produits, fournitures et services.
