Introduction


The Yukon Territory is Canada’s most northern and western political jurisdiction,
bounded on the west by the State of Alaska and on the south by the Province of British
Columbia.As a territory, it is technically administered by the FederalGovernment ofCanada
and is not considered a province, however, the Federal Government has passed legislation
granting to the Yukon Territory Legislature powers similar to those granted to the Canadian
provinces. Accordingly, the laws of the Yukon Territory are those enacted by the
Yukon Territory Legislative Assembly and those federal laws of Canada which apply in
all of the provinces and territories.


As in the Federal House of Commons, the Government of theYukon Territory is responsible
to the Yukon Legislative Assembly. The Premier and his Cabinet Members are all
elected. The Ministers are responsible to the Legislative Assembly for their department’s
activities and each department is administered by a non-elected Deputy Minister and
other senior staff who are civil servants and are not elected.


The Commissioner of theYukon Territory is the Queen’s representative in theYukon Territory
and is appointed by the Governor General of Canada.

The Courts established in the Yukon Territory are:
• The Territorial Court, which is similar in most respects to Provincial Courts which are
established in the provinces of Canada;
• The Supreme Court of the Yukon Territory, which has general jurisdiction over all
actions arising in theYukon Territory and which hears appeals from theYukon Territorial
Court; and
• The Court of Appeal, which hears appeals from the Supreme Court of the Yukon
Territory.
Appeals may be taken from the Court of Appeal of the Yukon Territory under certain circumstances
to the Supreme Court of Canada.


Establishment of Enterprises


General


Entities carrying on business in the Yukon Territory come under the jurisdiction of the
Federal Government of Canada, the Government of theYukonTerritory and, if business is
carried on in a municipality designated as such, the bylaws of that municipality.
