"Seizure" of Persons - Part I Section 1 - Preview Page

1.01.1. Must Be Constitutionally Reasonable

1.01.1.1. IN GENERAL

The United States and Texas Constitutions govern the “seizure” of persons,a as well as the “seizure” of property and possessions.

The Fourth Amendment of the United States Constitution, in relevant parts, provides that:

The right of the people to be secure in their persons . . ., against unreasonable . . . seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing . . . the persons . . . to be seized.

Article 1, § 9 of the Texas Constitution, in relevant parts, provides that:

The people shall be secure in their persons . . . from all unreasonable seizures . . ., and no warrant . . . to seize any person . . . shall issue without describing them as near as may be, nor without probable cause, supported by oath or affirmation.2

Because of these constitutional provisions, no “seizure” of a persona may be “unreasonable.”3

Judge Robert R. Barton is a Senior District Court Judge in both Civil and Criminal cases and Hardy Professor (Emeritus) of Trial Advocacy at St. Mary’s University School of Law. Judge Barton was a civil trial attorney and prosecutor for sixteen years, a District Judge for twelve years, Professor of law at St. Mary’s for nine years, including six years as the Hardy Professor of Trial Advocacy. He is a co-author of Texas Rules of Evidence Manual 8th Ed. and the author of  Fundamentals of Texas Trial Practice - 3rd Edition.
