Preview Page Article 1. Subject-Matter of Regulation of Present Federal Law
1. The present Federal Law regulates relations connected with the application by the Russian Federation of jurisdictional immunities of a foreign State and the property thereof. 2. A foreign State shall enjoy jurisdictional immunities with respect to itself and its property, taking into account the provisions of the present Federal Law. 3. The provisions of the present Federal Law shall be subject to application unless the Russian Federation and a foreign State have agreed otherwise.
Article 2. Basic Concepts to be Used in Present Federal Law
For the purposes of the present Federal Law the following basic concepts shall be used: (1) foreign State: (a) a State other than the Russian Federation and the agencies of State power thereof; (b) constituent parts of a particular foreign State (or subjects of a foreign federated State or administrative-territorial formations of a foreign State) and the agencies thereof to the extent to which they are empowered to perform actions for the purposes of the effectuation of sovereign authority of the particular foreign State and act in this capacity; (c) institutions or other formations, irrespective of whether they are juridical persons to the extent to which they are empowered to perform and actually perform actions for the purposes of the effectuation of sovereign power of the particular foreign state; (d) representatives of a particular foreign state acting in this capacity; (2) property of foreign State – property belonging to a foreign State and situated on the territory of the Russian Federation;
William E. Butler, Emeritus Professor of Comparative Law in the University of London, attached to University College London, is the John Edward Fowler Distinguished Professor of Law at the Dickinson School of Law, Pennsylvania State University, and Founder and Director of The Vinogradoff Institute.
An authority on the legal systems of Russia and former Soviet nations, he is the author, co-author, editor or translator of more than 3,500 books and articles on Russian, Soviet, Kazakhstan, Ukrainian, Uzbekistan, and other Commonwealth of Independent States legal systems. He has acted as Counsel to the EBRD, European Union, World Bank, United Nations, and Department for International Development of the United Kingdom on individual law reform projects.
The recipient of numerous honors for his service to Russian and international law, Professor Butler is Academician of the National Academy of Sciences of Ukraine and the Russian Academy of Natural Sciences, Associate of the International Academy of Comparative Law, and Member of the Russian Academy of Legal Sciences. He has been elected to his fourth term as a member of the Russian International Court of Commercial Arbitration. In 2003 Professor Butler was awarded the G. I. Tunkin Medal by the Russian International Law Association.
